Labor Code Leaves No Room For Abuse By Employers - Lawyer

Employers will not be able to make up projects in order to turn permanent employment contracts into fixed-term contracts and the publicity around Labor Code modification has had dramatic touches, which were uncalled for, believes Serban Paslaru, the partner in charge of the employment practice at Tuca Zbarcea & Asociatii law firm.

"Modifications made to the labor law are aimed at the labor market and this time they are key modifications changing things in essential areas. The rule has been and will be that of sealing open-ended contracts, despite the changes endorsed in the implementation of fixed-term contracts", said Paslaru during a workshop on the changes made to the new Labor Code.

Though some discussions on the new Labor Code started from the premise that employers will exploit the possibility of sealing fixed-term contracts, Paslaru said that this type of contracts is still inked for jobs designed to help fill temporary needs.

"Employers will not be able to make up projects to hire on fixed-term contracts, they must pay attention to the situations that could be viewed as an abuse of rights. (...)", he said.
