05.01.2011 ZF English

Romania’s new Labor Code, pushed through the Parliament through a vote of confidence early March, takes effect Sunday and employers risk prison sentences for using illegal labor.

The new Labor Code introduces limited period work contracts, increases the probation period for recently hired employees and the notice period for outgoing employees.

According to the new Labor Code, professional performance, and not the employee's social situation, will be the main criterion considered in case of collective layoffs.

Also, employers cannot force employees to work more than 48 hours a week, including overtime and overtime must be compensated with days off within the next 60 calendar days.
